1. Acceptance and application
By using this website, you agree to the website provisions of these terms. When you request, approve or accept a booking, quotation or workshop service from Black Beard Garage, the relevant workshop provisions also apply together with any written quote, job card, invoice, warranty information or other terms given for that work.
If there is an inconsistency, the more specific written terms for the particular job apply to the extent of that inconsistency. Nothing in these terms excludes rights that cannot lawfully be excluded.
2. Website information
This website provides general information about our services. It is not a mechanical diagnosis, safety clearance, roadworthiness assessment, engineering approval or promise that a particular service or part is suitable for your vehicle.
Vehicle advice depends on inspection, specifications, condition, modifications, intended use and applicable requirements. Images are illustrative. Service availability, parts, timing and pricing can change without notice.
You may use the website for lawful personal or business enquiries. You must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape it unreasonably or use its content in a misleading or unlawful way.
3. Enquiries and bookings
An online booking submission through our website or MechanicDesk, email, message or chatbot interaction is a request only. A booking is not confirmed until Black Beard Garage communicates acceptance and the agreed date or next step.
You are responsible for providing accurate contact and vehicle information and for telling us about relevant symptoms, prior work, accident damage, modifications, known hazards, immobilisers, wheel-lock keys or special operating instructions.
Requested dates are preferences and may not be available. Please contact us as soon as possible if you need to change or cancel an arranged booking.
Urgent safety concern? Do not rely on the website or chatbot. Stop using the vehicle if it may be unsafe and contact an appropriate roadside, towing or emergency service.
4. Quotations, estimates and additional work
A quotation or estimate is based on information reasonably available at the time. It may be subject to vehicle inspection, dismantling, diagnostic work, parts availability and confirmation of the actual fault or condition.
An estimate is an indication rather than a fixed price. A fixed quotation applies only to the work and assumptions stated in it and remains subject to any stated validity period or exclusions.
Vehicles can contain hidden wear, damage, incorrect prior work or related faults that are not reasonably apparent before work begins. If additional work or a material price change becomes necessary, we will seek further approval where reasonably practicable before proceeding, except where limited action is reasonably necessary to protect safety, prevent further damage or reassemble the vehicle, and the law permits it.
Diagnostic time and inspections may be chargeable even when you decide not to proceed with a repair, if this was disclosed or reasonably agreed as part of the job.
6. Services, repairs and parts
We will perform agreed services with due care and skill. Completion times are estimates unless expressly confirmed otherwise. Delays can occur due to diagnostics, hidden conditions, parts supply, third-party services, weather, transport or events outside reasonable control.
Parts
Parts may be new, reconditioned, remanufactured or used only as described or agreed. Manufacturer or supplier warranties may apply in addition to rights under the Australian Consumer Law.
Customer-supplied parts
We may decline to install customer-supplied parts that appear unsuitable, unsafe, incomplete, unlawful or incompatible. Unless required by law, we are not responsible for the quality, fit, performance or failure of a customer-supplied part, but we remain responsible for the standard of installation work we perform.
Removed parts
If you want removed parts returned, ask before work begins. Return may not be possible where a part must be exchanged, returned under warranty, disposed of safely or retained as required by law.
7. Vehicle modifications and upgrades
Modification outcomes depend on the vehicle’s condition, component combination, load, tyres, suspension geometry, intended use and other systems. A modification can affect handling, braking, reliability, fuel use, warranty, insurance, registration and legal compliance.
Before approving work, tell us the intended use and all relevant existing modifications. Proposed work remains subject to inspection, component suitability, availability and applicable requirements, which may include the Australian Design Rules, NSW road and vehicle standards, certification or engineering approval.
Unless expressly included in writing, a workshop quote does not include independent engineering certification, registration changes, insurer approval or third-party testing. Both the workshop and customer must comply with obligations that apply to them; these terms do not transfer or exclude a responsibility imposed by law.
Use the vehicle within its lawful limits and follow any operating, inspection, retorque, maintenance or bedding-in instructions provided after work.
8. Payment, collection and uncollected vehicles
You must pay the agreed charges by the due time shown on the quote, job card or invoice. Unless another arrangement is accepted in writing, payment is due when the work is complete and before the vehicle is released.
We may retain possession of the vehicle or parts until amounts properly due for the authorised work are paid, where permitted by law. If a vehicle is not collected after notice that it is ready, reasonable storage or administration charges may apply only where they have been disclosed or are otherwise permitted by law.
Uncollected vehicles and goods will be handled in accordance with applicable NSW law. Please tell us promptly if a collection problem arises so an arrangement can be discussed.
9. Australian Consumer Law
Our services and goods may come with consumer guarantees under the Australian Consumer Law that cannot be excluded. Depending on the circumstances, you may be entitled to a repair, replacement, refund, repeat service, compensation or another remedy for a failure to meet an applicable guarantee.
Any warranty statement, exclusion or limitation in these terms applies only to the extent permitted by law and does not restrict a non-excludable consumer right.
If you believe there is a problem with work we performed, stop using the vehicle if continued use may cause damage or create a safety risk, and contact us promptly with the invoice details and a description of the issue. Give us a reasonable opportunity to inspect the concern where appropriate.
10. Liability and matters outside our control
To the extent permitted by law, Black Beard Garage is not responsible for loss caused by inaccurate or incomplete information you provide, pre-existing faults, normal wear, misuse, motorsport or use outside advised limits, unauthorised later work, failure of a customer-supplied part, or events outside our reasonable control.
We are not liable for indirect or consequential loss to the extent it is lawful to exclude that liability. Any permitted limitation is subject to the Australian Consumer Law and other rights that cannot be excluded.
External websites linked from this site are controlled by third parties. A link does not mean we endorse or control that service, and use of it is subject to the third party’s terms.
11. Intellectual property, privacy and general terms
Unless otherwise stated, the website design, business name, logo, original text and other site material are owned by or licensed to Black Beard Garage. You may view or print reasonable extracts for personal reference, but may not republish or commercially exploit them without permission.
Personal information is handled as described in our Privacy Policy.
If part of these terms is invalid or unenforceable, it is read down or severed to the minimum extent necessary and the remaining provisions continue. A delay in enforcing a right is not a waiver of that right.
These terms are governed by the laws of New South Wales, Australia, and the parties submit to the courts with jurisdiction there.
We may update these terms by publishing a revised version on this page. The terms that apply to confirmed workshop work are those accepted or provided in connection with that work, unless a change is required by law.
